Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the AutoTCG application and website at autotcg.com(the “Service”), operated by getClear Digital(“we,” “us,” or “our”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

The Service

AutoTCG helps you scan trading cards, identify them, estimate pricing, and prepare and publish inventory listings to connected commerce providers. Features may change, and we may add or remove functionality over time.

Accounts and eligibility

You must be at least the age of majority in your jurisdiction and able to form a binding contract. You are responsible for your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

Acceptable use

• Do not use the Service for any unlawful or infringing purpose.
• Do not upload content you do not have the right to use, or that violates the rights of others.
• Do not attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its systems.
• Do not misuse automated identification or pricing outputs in a way that misleads buyers.

Your content

You retain ownership of the card images, inventory, and other content you provide (“Your Content”). You grant us a limited license to host, process, and use Your Content as needed to operate and improve the Service, including processing images through identification and pricing systems. You are responsible for the accuracy and legality of Your Content.

Identification and pricing estimates

Card identifications, condition assessments, and pricing estimates are provided for informational purposes only and are generated in part by automated systems. They may be incomplete or inaccurate. You are solely responsible for reviewing and confirming card identity, condition, and price before listing or selling. We do not guarantee any sale, valuation, or market outcome.

Third-party integrations

The Service integrates with third-party providers such as Square and Google. Your use of those services is governed by their own terms and privacy policies. You are responsible for maintaining your accounts with those providers and for compliance with their rules. We are not responsible for third-party services.

Fees

Paid plans, if offered, are billed as described at the time of purchase. All fees are non-refundable. We may change pricing with reasonable notice.

Intellectual property

The Service, including its software, design, and trademarks, is owned by us or our licensors and is protected by law. These Terms do not grant you any right to our intellectual property except the limited right to use the Service as permitted here.

Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or accurate.

Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months before the claim.

Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

Governing law

These Terms are governed by the laws of Manitoba, Canada, without regard to its conflict-of-laws rules. Disputes will be resolved in the courts located in Manitoba, Canada.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new effective date, and continued use of the Service after changes take effect constitutes acceptance.
